Terms of Use

These Terms of Use ("Terms") are an agreement between you and Daryl van Sittert, trading as Zumino (a sole proprietorship, South Africa) ("Zumino", "we", "us") governing your use of the Zumino platform — the website, applications, AI-assisted site builder, hosting infrastructure, and related services (together, the "Service").

By creating an account or using the Service you accept these Terms. If you do not agree, do not use the Service.

1. The Service

Zumino lets you create websites through natural-language conversations with an AI assistant, preview them, and publish them to the public internet under a Zumino-provided subdomain or, on eligible plans, a custom domain. Details of what is offered on each plan are described in Products & Services.

2. Accounts

  1. You must sign in with a supported identity provider (currently Google). You are responsible for safeguarding access to that account.
  2. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
  3. You are responsible for all activity that occurs under your account.
  4. You may delete your account at any time from the app. Deleting your account cancels any active subscriptions and initiates the removal of your published sites from the internet; removal is normally immediate, and any step that cannot complete immediately is finished as part of our routine cleanup processes (see the Refund Policy for how billing is handled and the Privacy Policy for data retention after deletion).

3. Your content

  1. Ownership. You retain all rights to the content you create with the Service, including the websites generated in your projects ("User Content"). Zumino does not claim ownership of User Content.
  2. Licence to us. You grant Zumino a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, and display User Content solely as needed to operate the Service — for example to store your project in a repository, run editing sessions, generate previews, review content for policy compliance, build your site, and serve it to visitors.
  3. Your responsibility. You are solely responsible for User Content and for ensuring you have the rights to everything you include in it. Published sites are attributed to you, not to Zumino.
  4. AI-generated output. The Service uses AI models to generate site content and code. AI output may contain errors, may be similar to output generated for others, and is provided without any warranty of accuracy, originality, or fitness for purpose. You are responsible for reviewing AI output before publishing it.

4. Acceptable use and content moderation

  1. You must comply with the Acceptable Use Policy ("AUP"), which forms part of these Terms. In short: no unlawful, malicious, deceptive, or abusive content or behaviour.
  2. Automated review. You acknowledge and agree that content you submit for publishing may be automatically reviewed (including by AI-based systems) for compliance with the AUP and applicable law before it is deployed, and may be reviewed or re-reviewed at any time after publication. Automated review is a safety measure, not a guarantee: it may be unavailable or incomplete for a given publish, and a deployment does not mean the content was reviewed or approved.
  3. Enforcement. Zumino may, at its sole discretion and without prior notice, decline to publish, delay, suspend, unpublish, or remove any content, and may suspend or terminate accounts, where we reasonably believe the AUP or these Terms have been violated or where required by law. We are not obliged to notify you of, or give reasons for, a moderation decision, particularly where doing so could facilitate evasion of our safety systems, and we may withhold the outcome of a review entirely.
  4. Moderation is automated and imperfect: a decision to publish content is not an endorsement, and a failure to detect a violation does not waive our right to act on it later.
  5. If you believe your content was affected in error, you may contact support (see Contact Details). We will review such requests in good faith but final decisions rest with Zumino.

5. Plans, billing, and tokens

  1. Paid plans, prices (in South African Rand), AI token allowances, and published-site limits are described in Products & Services.
  2. Subscriptions renew automatically each month until cancelled. Payments are processed by our payment provider, Paystack; by subscribing you also agree to Paystack's applicable terms.
  3. Upgrades take effect immediately upon payment. Downgrades and cancellations take effect at the end of the current billing period and cannot be reversed once requested (you may re-subscribe afterwards).
  4. If a renewal payment fails, we allow a grace period (currently 7 days) to update your payment method, after which your account reverts to the Free plan and plan limits are re-applied.
  5. When your plan's limits are re-applied (on downgrade, cancellation, or failed renewal), sites exceeding your published-site limit may be unpublished and custom domains exceeding your entitlement may be detached from routing after notice. Content is not deleted by a downgrade.
  6. AI token allowances are consumption-based service credits, not money or property. Unused allowance does not roll over beyond the mechanics described in Products & Services, has no cash value, and is not transferable. When your balance is exhausted the Service may degrade AI features (for example by switching to a reduced model) rather than blocking you.
  7. Advertising on the Free plan. To help support the cost of providing free hosting, we reserve the right to display adverts on websites published on the Free plan. Upgrading to a paid plan removes any Zumino-placed adverts, as described in Products & Services.
  8. Refunds are governed by the Refund Policy.
  9. Changes to pricing and quotas. The Service is built on third-party infrastructure and AI models whose costs (including AI token pricing and compute/hardware costs) are volatile and outside our control. We therefore reserve the right to change plan prices, AI token allowances, plan quotas (such as published-site and custom-domain limits), and other plan features over time. We will give at least 30 days' notice of any price increase or material reduction in what your plan includes; changes apply from your next billing period after the notice period. If you do not accept a change, you may cancel or downgrade before it takes effect.

6. Hosting, domains, and availability

  1. Published sites are served under a Zumino subdomain or, where your plan allows, a custom domain you connect or purchase through the Service.
  2. Domain registrations are subject to the registry's and our registrar partner's terms in addition to these Terms.
  3. The Service is provided on a reasonable-efforts basis. We do not guarantee uninterrupted availability, and we may perform maintenance, throttle abusive workloads, or apply fair-use limits to protect the platform.
  4. We may modify or discontinue features of the Service. If we discontinue the Service as a whole, we will give reasonable notice and a means to export your content where practicable.

7. Intellectual property

The Service itself — including its software, design, branding, and documentation, but excluding User Content — is owned by Zumino or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service in accordance with these Terms. "Made with Zumino" attribution appears on published sites on plans that include it, as described in Products & Services.

8. Privacy

Our collection and use of personal information is described in the Privacy Policy, which forms part of these Terms.

9. Third-party services

The Service depends on third-party providers (including AI model providers, source-code hosting, payment processing, and content-delivery networks). Their availability and conduct are outside our control, and your use of features they power may also be subject to their terms.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that the Service (including AI output and content moderation) will be accurate, error-free, or uninterrupted. Nothing in these Terms limits any rights you have under the South African Consumer Protection Act 68 of 2008 ("CPA") or other law that cannot be limited by agreement.

11. Limitation of liability

To the maximum extent permitted by law:

  1. Zumino is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
  2. Zumino's total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid to Zumino in the 3 months preceding the event giving rise to the claim, and (b) R1,000.
  3. You are responsible for content you publish. You indemnify Zumino against third-party claims arising from your User Content or your breach of these Terms or the AUP.

12. Suspension and termination

  1. You may stop using the Service and delete your account at any time.
  2. We may suspend or terminate your access immediately if you materially breach these Terms or the AUP, if required by law, or to protect the Service or its users. Where reasonable, we will provide notice.
  3. On termination, your right to use the Service ends and your published sites may be taken offline. Clauses that by their nature should survive (including 3, 10, 11, and 14) survive termination.

13. Changes to these Terms

We may update these Terms from time to time. For material changes we will give notice (for example by email or an in-app notice) at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have jurisdiction over any dispute arising from these Terms, without prejudice to any consumer rights to bring claims in another forum. Nothing in these Terms limits your rights under the CPA, the Electronic Communications and Transactions Act 25 of 2002, or the Protection of Personal Information Act 4 of 2013 ("POPIA").
